The Supreme Court of Ghana has affirmed the constitutional validity of the Office of the Special Prosecutor (OSP) and dismissed challenges seeking to invalidate its prosecutorial powers.

The Court recognised the Attorney-General’s constitutional role as the repository of the State’s prosecutorial authority under Article 88, while upholding the OSP’s statutory mandate under Act 959 to independently investigate and prosecute corruption-related offences.

The judgment clears the way for the OSP to continue executing its mandate of investigating corruption, prosecuting offences within its jurisdiction, and pursuing asset recovery.

The Court also set aside the High Court decision in the Archibald Hyde matter and preserved actions undertaken by the OSP before that decision.
